This website has been designed to provide the public with information and to give Prince George residents, workers and visitors of the Veteran's Land Act Subdivision (VLA) area an efficient way to express their frustrations, complaints and comments to the government authorities who have the power and ability to facilitate the installation of a safe user-friendly left-turn lane access into the VLA on Highway 97 south at Spruce/ Victoria/ Ford Streets.
For over 20 years the community, travelers and taxpayers of Prince George have been frustrated with the lack of a safe user-friendly southbound left turn access from HWY 97 into the VLA at Spruce, Victoria, and Ford streets in Prince George, B.C. (e.g. a safe user-friendly left-turn similar to the ones installed on the Highway at 18th Ave (CNC), Range road (Costco/Woodwheaton), for the Treasure Cove Casino, Recplace Drive, and many other places in the P.G. area).
In response to this demand, in the last seven years, two petitions have been submitted to the Ministry of Transportation. The first petition presented in 2001 was signed by 5500 people, while the second in March of 2008 was signed by 6000 people. Despite these two petitions, nothing yet has been done to build the safe user-friendly left turn lane.
Two top bureaucrats in the Ministry of Transportation, Shanna Mason, the Regional Director; and Rick Blixrud, the District Manager, have insisted that they need to receive more direct public input before they can act.
Time is of the essence. Crews for the $42 million Simon Fraser Bridge Twinning Project will soon be working in the area to widen and realign the highway, and this is a perfect opportunity to add this safe user-friendly left turn lane at a fraction of the cost that it would take at any other time.
Does somebody have to die before the Ministry will install a safe user-friendly left turn lane?

Re: Hwy 97 Left Turn Lane for your Veteran Land Act neighbourhood constituents in Prince George, B.C.
With the Opening of the new Simon Fraser Bridge on August 23, 2009, we wish to thank you for all your hard work as our MLA in bringing this impressive highway improvement project for the benefit of the residents, workers and visitors of Prince George and we look forward to IDL Projects Inc. total completion of this entire highway project later this fall.
Shirley, ever since you became our MLA and have been involved in the long standing matter of the public's request for a Hwy 97 Left Turn Lane to reduce driver frustration and improve basic access for thousands of residents, workers and visitors of the Veteran Land Act (VLA) neighbourhood, you have always maintained that this public improvement request was entitled to receive a fair hearing. However, as you know, for whatever reason, since 2001, you have had to apply pressure every step of the way to try and get Ministry of Transportation (MoT) senior public servants to give the project a fair hearing and consideration. For this support and effort we are grateful to you as our MLA.
Everyone is in agreement with the Minister of Transportation that safety must be the primary concern and that the project should only proceed if it meets industry standard traffic engineering/safety practice and requirements. The internationally respected transportation safety expert (Chair of the Transportation Safety Council, ITE) , Russell G. Brownlee, B.Sc., M.A. Sc., FITE, P.Eng., from Giffin Koerth Forensic Engineering (in Toronto) has shown that true scientific/engineering evidence clearly demonstrates that the left turn lane facility will operate at good levels of highway safety and service and we know that ever since the meeting you held at your office in December 2004 that you supported this public project being included with the Bridge Project because of the several hundred thousand dollars of taxpayer money that will be sensibly saved if it is completed with the Bridge Project (i.e. a cost of $500,000 if completed this fall by IDL Projects Inc. with the Bridge project verses ~$1,000,000 if it is done as a stand-alone project).
Shirley, in July 2009, we applied to the B.C. Supreme Court for an order that the Minister of Transportation's decision not to allow a left turn lane be quashed and that the matter be referred back to the Minister for reconsideration because it is evident that natural justice and truth are on our side. We sincerely hope that you will closely examine the facts of the case which we have filed with the B..C. Supreme Court so that you can see the injustice that has occurred.
We would not be taking this matter to court unless we were very confident that we will win on the grounds that: 1) defective and inappropriate evidence was accepted and cogent and appropriate evidence was ignored, and 2) that there is significant evidence clearly demonstrating bias or a reasonable apprehension of bias.
We write this letter in hopes of being able to appeal to your common sense and good judgement because it appears that stall tactics are being used to run the time out so that we cannot receive a fair Judicial Review hearing before IDL Projects Inc. completes the highway widening work for the new Bridge.
Freedom of Information records show that BC taxpayers have paid over $31,000 for the EBA Engineering Consultants Ltd. Report (EBA Report) that the Minister's decision is based upon; however, this EBA Report was not duly sealed by any engineer as required by the Association of Professional Engineers and Geoscientists of BC (APEGBC). If the MoT Chief Engineer, the EBA report authors, and a traffic engineer from EBA Engineering haven't complied with BC law by duly sealing their respective engineering reports / documentation / letters, as required by APEGBC, does this not emphasize to you that there are serious problems with the EBA Report? This appears to be a quiet but clear sign and statement that none of these engineers want to proclaim to the public that they are prepared to be held professionally accountable for their engineering work and advice to the Minister of Transportation. Does the fact that over $31,000 of taxpayer money was paid to engineers for reports that appear to be in breach of BC law raise any red flags for you?
In September 2008 and in June 2009 we asked multiple MoT senior public servants numerous times to provide us with a duly sealed copy of the EBA Report, but to no avail. On June 25, 2009 the MoT Chief Operating Officer, Dave Byng, responded by email to our last request and he stated, "The [EBA] report did not have an embossed stamp as it was sent electronically with digital signatures and electronic seal technology, which is approved by the Association of Professional Engineers and Geoscientists of BC". We have since learned from APEGBC that the authors of the EBA Report have not even obtained the APEGBC approved Digital Signature and Electronic Seal Technology. Not only this, but APEGBC has confirmed that the digital seal technology was not made available to APEGBC members until after September 2008 (note: the EBA Report was completed in August 2008).
In an email earlier this year to Eldon Matte regarding truth, Shirley, you stated:
"I have been a publicly elected official for about 15 years. During that time and throughout the rest of my life whether public or personal, I have always believed that truth and integrity are key to how I live my life. I have worked hard to do that to the best of my ability. My track record speaks for itself - I work tirelessly on behalf of the people that elected me and I endeavour to do that with the values that characterize my life which was very much shaped by the wonderful family life I had. As I look at the experiences that I have had in public service, I believe that the vast majority of people who run for elected office do so for the right reasons and that the values that are important to me would be shared by them as well. Like most other elected representatives I try to be consistent and careful to reflect the truth in my comments and actions."
As our MLA and as the Minister of Transportation, we trust in your integrity and ask that you take this case very seriously. There are simple matters (such as the above) that we believe you are able to get to the bottom of very quickly and which could lead to you discovering the truth of the matter in order for you to ensure that natural justice and truth will prevail quickly without an order from the court. If this case does not receive a fair hearing before it is too late for IDL Projects Inc. to construct this project this fall with the Bridge Project completion, this will only add to the injustices already served to your constituents and taxpayers (residents, workers, visitors and employers) in this matter.
As a trustee of the common good, we trust that you will ensure: 1) that MoT senior public servants are held accountable for their actions 2) that MoT senior staff fulfill their entire Public Service Oaths and 3) that BC Laws are not being breached by the engineers you are choosing to rely on for professional advice.
While we understand that you prefer to not comment on this matter because legal proceedings are underway, we respectfully ask and urge you to please explore all your options and do what you can to help now in any way that you feel you are able to correct all of the injustices in this matter quickly before IDL Projects Inc. complete the highway widening work for the Bridge Project.
We are hoping to have a discussion soon with an APEGBC director to discuss the process for initiating complaints against the engineers who appear to be violating BC law and their APEGBC obligations. Would you like to be a part of this discussion?

B.C. Supreme Court Application Filed for Judicial Review of VLA Hwy 97 Left Turn Lane Decision.
In 2008, Prince George City Council, the local MLAs, the local MPs, over 6000 residents, workers, visitors and seven local VLA employers petitioned the Ministry of Transportation to include a safe, user-friendly Hwy 97 Left Turn Lane into the VLA at Victoria / Spruce / Ford Streets with the Simon Fraser Bridge Project. The Ministry promised to construct the proposed project if it was scientifically proven that it would operate at normal levels of highway safety and service. In August 2008, the Ministry of Transportation released an "independent" traffic study which appeared to indicate that the project would be unsafe. As a result, the MoT decided to not proceed with the project. In April 2009, Russell G.. Brownlee, B.Sc., M.A. Sc., FITE, P.Eng., who is an internationally respected transportation safety expert with Giffin Koerth Forensic Engineering from Toronto, conducted a Peer Review of the Ministry’s "independent" 2008 traffic study and his analysis found significant deficiencies resulting in erroneous conclusions. Mr. Brownlee also conducted a new independent transportation study using the most current data and this new study scientifically demonstrates that the Left Turn Lane will operate at a good level of highway safety and service both now and in the future.
One key piece of basic evidence that is different in the two studies is that the "existing" opposing Northbound (NB) Hwy 97 peak hour traffic volume used by the MoT in their study last August is over 40% more than what actually exists at the Spruce/Hwy 97 intersection. The MoT’s “independent” engineers have not been able to provide Mr. Brownlee with any scientific/industry standard traffic engineering quantification for why their "independent" study used the inflated 1346 vehicles per hour (vph) as the "existing" opposing peak hour volume. They refused to accept the fact that Mr. Brownlee has correctly identified the design peak hour for the existing NB Hwy 97 traffic to be about 935 vph.
LeftTurnNow.com - Community Action Group provided the Peer Review and the positive new transportation study to the Ministry of Transportation in April 2009. However, as of June 25, 2009, the MoT Chief Engineer (who made the decision for the Ministry) still refused to accept that the Left Turn Lane into the VLA at Victoria / Spruce / Ford Streets will operate at good levels of highway safety and service.
The Ministry of Transportation appears to have accepted defective evidence and ignored cogent evidence. As a result, an application is being made to the B.C. Supreme Court for an order that the Ministry's decision not to allow a left turn lane be quashed and that the matter be referred back to the Minister for reconsideration.
The Judicial Review Application was filed in the B.C. Supreme Court on Friday, July 17, 2009, and is being brought forth jointly by Stuart Brown; (a resident of the VLA community), and P.G. Realty & Insurance Agency Ltd.; (a VLA property owner), on behalf of the thousands of residents, workers, visitors, and local VLA employers who petitioned the Ministry last year to include the safe, user-friendly left turn lane with the Bridge Project.
We hope our MLA, Hon. Shirley Bond, Minister of Transportation will discover the truth quickly, intervene in the case and approve the installation of the left turn lane. Significant money will be wasted if IDL Contractors finish construction on that section of Highway 97 and must redo the same work to install the left turn lane afterwards.

The requested southbound left-turn lane on Hwy 97 into the Veteran Lands Act neighbourhood at Victoria & Ford Sts will not compromise highway safety or traffic flow and it will “operate at a good level of service under existing and future operating conditions" says a new independent transportation study conducted by Russell G.. Brownlee, B.Sc., M.A. Sc., FITE, P.Eng. with Giffin Koerth Forensic Engineering from Toronto http://www.giffinkoerth.com/ . Brownlee, who is also the Chairman of the Transportation Safety Council for the Institute of Transportation Engineers http://www.ite.org/councils/Safety/default.asp (an international educational and scientific association of transportation professionals), was recently asked by the Community Action Group - LeftTurnNow.com to visit Prince George and do an independent traffic study and also conduct a Peer Review of the study commissioned last summer by the Ministry of Transportation.
Last spring and summer, over 6000 residents, workers & visitors of the Veteran’s Land Act neighbourhood, Prince George Mayor and Council, local MP’s, the three local MLA’s, local businesses and the NDP Transportation Critic MLA-Maurine Karagianis all asked Honourable Kevin Falcon, Minister of Transportation to include a left turn lane on Hwy 97 southbound with the Bridge Project.
While speaking to news reporters on July 7, 2008, Minister Falcon promised that he would introduce the new left turn lane if it is scientifically shown that it will not compromise traffic flow and highway safety. This latest Transportation Study and Peer Review clearly demonstrates that the left turn lane into the Veteran’s Land Act neighbourhood satisfies all of Minister Falcon’s conditions.

For years residents, travelers and the P.G. community have been unsatisfied with the lack of a safe user-friendly southbound left-turn access from Highway 97 into the Veteran's Land Act Subdivision (VLA) area at Spruce, Victoria, and Ford streets. (e.g. a safe left-turn similar to the ones installed on the Highway at 18th Ave (CNC), Range road (Costco/Woodwheaton), for the Treasure Cove Casino and many other places in the P.G. area). The lack of this sensible safe left-turn frustrates motorists, contributes to unsafe traffic congestion at various locations on Ferry Avenue and causes people to make risky U-turns in the middle of Highway 97.
For over twenty years, employees and business owners at Spruce and Ford Streets in the VLA have been on the front line for hearing complaints daily from tourists and residents about this frustrating and unsafe transportation condition and get tired of hearing all these Ministry of Transportation's complaints (also - the amount of time wasted by people giving directions is staggering). So to give people a place to vent their frustrations, over the years various petitions asking the government to do something were placed at the each of the businesses. This was thought to be the best way to let the Ministry know about the problem and that they had a bunch of unhappy, frustrated taxpayers, residents and travellers here. In 2001 Bill Lynch, Chair of the P.G. Development Corp (now called Initiatives P.G.) submitted a petition and in his letter he asked the government to take immediate action to remedy the situation. But the government has only stonewalled and ignored these past petitions.
Most recently, on March 26, 2008, a public petition with over 6000 supporters was submitted to the government to have this safe, user-friendly left-turn installed as part of the roadwork for the $42 million Simon Fraser Bridge Twinning Project (which is the most feasible time to build it, since crews will already be working in the area to widen and realign the highway). The seven local businesses submitted the petition jointly and because they don't want to see this perfect opportunity be ignored again, they committed to contribute $10,000.00 each for a total of $70,000.00 to help out if it is done along with the bridge project. A letter from L&M Engineering (an experienced local engineering firm), which was also submitted along with the petition, confirmed that a safe left-turn is entirely possible to do and that the most feasible time for the government to build it is at the same time as the Bridge Project.
On March 31, 2008 the seven businesses went to City Council to present them with a copy of the petition and requested Council's support to convince the Province to include it with the Bridge Project, to which Council voted unanimously to do. On April 2, 2008 Mayor Colin Kinsley sent a letter to the Minister of Transportation requesting the Left turn be included with the Bridge Project.
Federal MP's, Dick Harris and Jay Hill also received copies of the petition and on April 8, 2008 Dick Harris sent a letter to the Minister of Transportation stating he is also in support of the left-turn. Both MP's have subsequently indicated that if additional federal funds are needed for the project, all the province needs to do is make application under the Building Canada Fund and it can access additional funding to help out.
The two top local bureaucrats in the Ministry of Transportation, Shanna Mason, the Regional Director; and Rick Blixrud, the District Manager called a meeting with the seven businesses on May 22, 2008. The bureaucrats said they wanted to hire an out-of-town engineer to do a traffic study to confirm that a Left-turn would be a good way to improve access to the area and to confirm the exact size it should be. Even though Shanna and Rick recognized that the left-turn could be built now with the bridge project for a fraction of the cost that it would take at any other time, Shanna said she made the decision they were not going to do it with the bridge roadwork and insited they needed to hear directly from the public before it is included. Shanna and Rick also said that because they haven't heard many complaints directly from residents, motorists and tourists, they don't think there is any problem with the current situation and will be ignoring the 6000 name petition.
On July 7, 2008 LeftTurnNow.com has resubmitted the 6000 name petition to the Minister and have obtained a Conceptual Plan from L&M Engineering with estimates of under $500,000 for the Ministry to build the left-turn with the Bridge Project.
Minister Falcon, on August 25, 2008, rejected requests and an urgent plea to meet with community members prior to releasing his "final" decision on the left turn lane and chose instead to allow the heavy hand of his Ministry to befall on the residents, workers and visitors of the VLA without discussion. In his press release Minister Falcon said he will not permit the construction of the left turn lane because an "independent" study (which ministry officials, Rick Blixrud and Shanna Mason commissioned EBA Engineering to do) claims a left turn lane "would be unsafe and interrupt Hwy 97 traffic flow". However, the study's outcome is very problematic because among many other things, the study has a very narrow focus and the authors sought no input or involvement from city officials or community members. Upon reviewing the study; residents, workers and visitors of the VLA are left very puzzled how the Ministry was ever able to approve many of the other left turn lanes they are familiar with around Prince George, most particularly the one at Hwy 97 & 18th avenue and the new one recently installed by the City of PG at Recplace drive on Hwy 16w.
As numerous residents, workers and visitors of the VLA are alleging that there is serious unfairness taking place within the Ministry regarding the left turn lane request for the VLA, the public action committee, LeftTurnNow.com is currently in the process of making a number of Freedom of Information requests to the Ministry to gather all the information on this left turn lane request as well as many of the other left turn lanes the public is familiar with. Provided the government fully co-operates and allows LeftTurnNow.com to recieve this public information unimpeded by the large fees which the government is now trying to charge to release them, LeftTurnNow.com will disseminate the information to the public for the public benefit of better public understanding of: a) the full and actual processes by which left turn lanes are given fair consideration and/or approved, b) the important matters of public safety and interest typically considered regarding left turn lanes, c) the actual procedure by which public and financial resources are allocated to construct left turn lanes in the province, d) other matters of public interest which the records will likely contain.
Q. Who is LeftTurnNow.com?
A. LeftTurnNow.com is the name of a community action group who is very concerned about the negative impacts which the absence of a user-friendly left-turn has on Public Safety, the Environment, and the Common-Good. We are founded and made up of a large number of persons who live, work and visit in the VLA area and we have the support of over 6000 people who signed the petition requesting the installation of a safe user-friendly left-turn now!
Q. Should the businesses pay 100%?
A. No. This is a public safety issue. The intersection in it's current configuration is both dangerous to drive and difficult to navigate. The Simon Fraser Bridge Project is being done to improve the transportation network for Residents, Workers and Visitors. Including a left-turn into the VLA area at Spruce/Victoria/Ford Streets with the Bridge Project is a public safety benefit that will improve basic access and reduce driver frustrations for over 6000 Residents, Workers and Visitors who need this safe left-turn.
Q. Will a Left-turn make Victoria Street a shortcut to downtown?
A. No. If you look at a large map, you will see that the left turn will primarily benefit motorists coming from the north and west. It would be much faster and shorter for them to stay on the main highway 16 to get downtown than to drive out of their way, turn left and use side streets to get to downtown.
Q. Could the Ministry place a barrier in the middle of the Hwy all the way to the bridge to prevent U-turns and Left-turns?
A. They could, but this will cost thousands of dollars and will do nothing to reduce driver frustration and improve basic access for over 6000 thousand residents, workers and visitors of the VLA who need a safe efficient user-friendly left-turn lane to access the area. A barrier is short sighted and will only shift congestion to Ferry and Upland (by Van Bien School) and at Ferry and the Hwy on/off ramps by the Bridge. On the other hand, the installation of a safe user-friendly Left-turn lane on the Hwy (as is done in many other locations), will alleviate the safety concerns and congestion on Ferry and Upland as well as improving access and safety on HWY 97.
Q. Are U-turns illegal on the Hwy 97 by Ford & Victoria St.?
A. Up until September 2008, Ministry officials confirmed U-turns were permissable in this location as per section 168 of the Motor Vehicle Act. ( see http://www.qp.gov.bc.ca/statreg/stat/M/96318_05.htm#section168 ). However in mid September 2008 the Ministry extended the barrier and placed a no U-turn sign which now makes it illegal to perform u-turns at this location.
Up until the mid 80's left-turns were permitted into Spruce Street from Hwy 97, just as they still are today on the Hart Hwy 97 at the Mohawk Gas station (where hwy traffic counts are much greater), however, in the mid 1980's rather than spending their money wisely to install a safe user-friendly access, the Ministry erected a barrier to deter people from making south bound turns from Spruce onto Hwy 97 S. This has now resulted in people making risky-uturns in the middle of the highway to access Spruce, Victoria and Ford.

It is estimated Approx 500 to 1000 vehicles each day have to travel up to an extra 1.7 Km (approx 1 mile or 2-3 minutes) via either Upland St, using the Ferry Ave on/off ramps or other roundabout ways.
If you are one of those drivers and you did this once a day for 300 days out of the year, you’d drive: say 2.5 min/day x 300 days = 750 Minutes = 12.5hrs of extra driving for you each year.
Say on average 725 vehicles drive this each day: 725 x 2.5min/day x 365 days = 11,000 Hrs of wasted driving by the public each year.
How much is your time worth to you and your family? $10, $20, $30/hr ? Say the average person’s time is worth $15/hr. 11,000 hrs x $15 = $165,000 of taxpayers’ time is wasted each year.
725 trips/day x 1.7 Km x 365 days = 449,000 km (279,000 miles) of wasted driving each year.
Let’s say the average of all hwy vehicles
(incld trucks, rigs, etc.) burns 16 Litres/100Km for city driving. 449,000 km/yr ÷ 100km x 16 L = 71,500 Litres (19,000 gal) of gas and diesel wasted each year.
With price of gas & diesel today near $1.50/L, 71,500L x 1.50= $107,000 of fuel wasted each year!
How is the Ministry helping to cut Green-house gas emissions? How does this help the air quality in Prince George? How much extra Carbon Tax are you paying for this? How user-friendly is the access for cyclists? How much extra do you have to pay for a taxi ride? What about all the extra cost for wear and tear on vehicles, tires and city streets? Does someone have to die before they will act (like at Jensen Road)? Etc?

This summer, the Ministry is spending $2.7 Million of your tax dollars on a Hwy Improvement Project at McBride Timber, Sweden, and Silver Rds, 25km west of Prince George. As part of this project, four (4) left-turn lanes will be built on Hwy 16 W. John Rustad’s May 23, 2008 News Release (at JohnRustadMla.bc.ca) says the project will “reduce driver frustrations and improve basic access for residents, workers and visitors”. This is a great safety improvement for the 80 or so residences, farms and 2-3 small businesses that will benefit from these four (4) left-turns.
Only one (1) user-friendly left-turn will be needed at Spruce, Victoria & Ford Streets to “reduce driver frustrations and improve basic access” for over 6000 residents, workers and visitors and it will be a minimal cost if included with the Bridge Project!
In 2004 the Ministry of Transportation lost one of their own staff members in a tragic accident at Jensen Rd. on Hwy 16 w. Within the next 12 months, after a loud out-cry from residents, the Ministry quickly found $800,000 to make the left-turn and other safety improvements which 80 or so residents had been petitioning years for.
